§1 General provisions

  1. The DARKSHOP online store operating at www.darkshop.com.plis run by: BROWAR JURAND limited liability company, REGON: 541585020, NIP 5253045372, UL. RONDO ORGANIZACJI NARODÓW ZJEDNOCZONYCH 1, 00-124 WARSZAWA e-mail:bok@mazurskamanufaktura.pl
  2. The Terms and Conditions define the rules for using the online store www.darkshop.com.pl, in particular: the rules for concluding and performing Sales Agreements for Goods available in the Store's assortment and the rules for providing services by electronic means (the regulation of services provided electronically is governed by the Terms and Conditions referred to in Article 8(1) of the Act of July 18, 2002, on the provision of electronic services (Journal of Laws of 2024, item 1513).
  3. Use of the Store is possible provided that the ICT system used by the Customer meets the following minimum technical requirements ensuring compatibility with the ICT system used by the Service Provider:
  4. a computer (or other similar device) with Internet access, equipped with a web browser (e.g., Internet Explorer version 11 and above, Mozilla Firefox version 20 and above, Chrome version 40 and above, Safari version 8 and above);
  5. JavaScript enabled in your web browser and cookies enabled;
  6. active email address.
  7. The Customer should use the Store in accordance with generally applicable laws and in accordance with the provisions of the Terms and Conditions. In particular, it is prohibited to:
  8. providing illegal content (e.g., content that violates personal rights or other rights of third parties);
  9. using the Store in a manner that disrupts its functioning (e.g., by using specific software);
  10. providing personal data that is untrue or infringes on the rights of third parties.
  11. This website, including the sale of alcohol, is intended for adults over the age of 18.
  12. The Terms and Conditions are available continuously, in a manner enabling Customers to obtain, reproduce, and record their content by printing or saving them on a medium at any time.
  13. Buyers have the option to:
  14. use the Store without registering or logging in, or
  15. complete registration using the tools provided and log in using the access data specified during registration

– on the terms and conditions specified in detail in these Regulations.

§2 Glossary of definitions

The following terms used in these Terms and Conditions have the meanings set out below:

  1. Email Address – designation of an ICT system enabling communication by electronic means.
  2. Personal data – any information relating to an identified or identifiable natural person processed by the Service Provider for the purpose of properly providing the Services specified in these Terms and Conditions, as well as for the purpose of concluding and performing a sales contract and for statistical purposes related to the operation of the online store.
  3. Registration form – a form available on the website at www.darkshop.com.pl, completed by the Customer in order to create a Customer Account.
  4. Customer – a natural person or other entity using the Online Store:
    a) a natural person with full legal capacity,
    b) a natural person who is at least 13 years of age and has limited legal capacity, in the event that the contract being concluded is of a nature commonly concluded in minor everyday matters or when such a person has obtained the legally effective consent of their legal representative to conclude the contract;
    c) a legal person and an organizational unit without legal personality to which the law grants legal capacity.
  5. Consumer – a natural person purchasing Goods for purposes unrelated to their professional or business activity.
  6. Customer Account – a login (e-mail address) assigned to the Customer and a password chosen by them, enabling them to: place orders without having to fill out the Order Form each time, view their order history, subscribe to the Newsletter, and change their details.
  7. Login – the email address entered by the Customer in the online store when creating an Account, enabling subsequent identification when using the online store.
  8. Newsletter – a service provided by BROWAR JURAND SP. z o.o. consisting in the periodic sending of information, including commercial information within the meaning of the Act of July 18, 2002, on the provision of electronic services (Journal of Laws of 2024, item 1513), about events, competitions, discounts, promotions, and other events to the e-mail address or telephone number provided by the Customer. on the provision of electronic services (Journal of Laws of 2024, item 1513), about events, competitions, discounts, promotions, and other events related to the Store's activities.
  9. Privacy Policy – terms and conditions explaining what personal data of users is collected, for what purpose, how it is processed and protected, and what rights users have in this regard, from each website and system that collects personal data, available athttps://www.darkshop.com.pl/pl/i/Polityka-prywatnosci/11,
  10. Terms and Conditions – these Terms and Conditions of the DARKSHOP online store. The Terms and Conditions are available at www.darkshop.com.pl/pl/i/Regulamin.
  11. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
  12. Store (also Online Store) – an online platform for the sale of Goods on the terms specified in the Terms and Conditions, operating atwww.darkshop.com.pl.
  13. Seller – BROWAR JURAND limited liability company, REGON: 541585020, NIP 5253045372, UL. RONDO ORGANIZACJI NARODÓW ZJEDNOCZONYCH 1, 00-124 WARSZAWA, e-mail: bok@mazurskamanufaktura.pl , in the scope of concluding and performing sales agreements concluded in accordance with the Regulations.
  14. ICT system – a set of cooperating IT devices and software ensuring processing and storage, as well as sending and receiving data via telecommunications networks using terminal equipment appropriate for the type of network within the meaning of the Act of July 16, 2004, Telecommunications Law (Journal of Laws of 2024, item 34).
  15. Electronic means of communication – technical solutions, including ICT devices and related software tools, enabling individual remote communication using data transmission between ICT systems, in particular e-mail.
  16. Goods – products that can be purchased through the Store, in accordance with the range indicated on the website www.darkshop.com.pl.
  17. Personalized Goods – Goods available in the Store with the option of custom printing at the Customer's request.
  18. Agreement – an agreement for the provision of electronic services between the Service Provider and the Customer.
  19. Sales Agreement – a sales agreement within the meaning of the Civil Code, concluded between the Seller and the Customer, in accordance with the Terms and Conditions.
  20. Services – services provided by the Service Provider to the Customer via the Store (services provided electronically).

  22. UŚUDE – Act of July 18, 2002, on the provision of electronic services (Journal of Laws of 2024, item 1513).
  23. Order – A service enabling Customers to place an order for the purchase of Goods via the online store (submitting an offer to conclude one or more sales agreements).

§3 Services provided electronically

  1. As part of the Store, the Service Provider provides the following Services electronically:
  2. Customer Account;
    a) Order,
    b) Shopping Cart,
    c) Newsletter.
  3. Use of the Store Services is free of charge.
  4. In order to create a Customer Account in the Store (registration), you must provide the Personal Data marked as mandatory (first name, last name, email address), choose a password, accept the Terms and Conditions, and click the "Register" button. The Customer's login is the email address provided during registration.
  5. Logging into your Customer Account in the Store is done using the email address provided during registration and a unique password known only to the authorized Customer.
  6. The Service Provider recommends that the Customer change their password at least every 30 days. The Service Provider requires that the password meet the requirements of a so-called strong password, i.e., a password consisting of at least 8 characters, upper and lower case letters, and numbers or special characters.
  7. In order to enable the Customer to fully use the functionality of the Customer Account (functionality available only to Customers who have created a Customer Account) in the Store, the Service Provider may also process other necessary Personal Data:
    a) My addresses (order delivery address),
    b) My orders (history of orders placed),
    c) Complaints (information regarding complaints about Goods),
    d) My Returns (information regarding the return of Goods),
    e) Newsletter (e-mail address, list of active newsletters).
  8. The contract is concluded upon receipt by the Customer of confirmation of the correct execution of the order in the Store, sent by the Service Provider to the e-mail address provided by the Customer at the stage of placing the order. The contract is concluded for an indefinite period.
  9. The Customer may delete their Customer Account at any time (without giving any reason and without incurring any costs). To do so, they should send an email requesting its deletion to: bok@mazurskamanufaktura.pl, providing the email address used during registration. Upon receipt of the message, the Customer Account will be deleted immediately. Upon deletion of the Customer Account, the agreement for the provision of the Customer Account service shall be terminated.
  10. The Service Provider may terminate the Customer Account service agreement with 14 days' notice for the reasons specified in § 1(4). The Service Provider's statement may be sent to the email address used during the registration of the Customer Account. After the notice period expires, the Customer Account service agreement shall be terminated.
  11. Notwithstanding the provisions of section 10 above, in the event of a gross violation by the Customer of § 1 section 4 points 1-3 of the Terms and Conditions, the Service Provider shall be entitled to restrict the Customer's access to the Services in whole or in part.
  12. In order to place an Order, you must provide the Personal Data marked as mandatory, i.e.:
    a) address details (first name, last name, street and house number, postal code, city, country, email address, telephone number,
    b) invoice details – if the Customer wishes to receive an invoice (company name, company address, tax identification number),
    c) delivery and payment (delivery method, payment method),
    d) and accept the Terms and Conditions.
  13. The Order Service is a one-time service. The Service can be used from the Customer Account or without registration. In the case of a purchase without prior registration, the Service begins when the "continue without registration" button is clicked. The use of the Service ends after the Order has been completed by the Store or as a result of the Customer's earlier termination of the Order.
  14. The Service Provider enables the Customer to view the content posted in the Store.
  15. The Service Provider provides the Customer with the Shopping Cart Service in order to facilitate the ordering of Goods, in particular: remembering selected Goods, entering any discount codes, displaying a summary of the price and delivery costs. When using the Shopping Cart, more than one offer to conclude a sales contract may be placed in a single Order. The Shopping Cart service is a one-time service.
  16. Use of the Shopping Cart Service begins when you click the "add to cart" button and ends when you place your order or click the "empty cart" button. Adding Goods to the Shopping Cart does not mean that they are reserved, however, the Shopping Cart remembers information about the Goods selected by the Customer even after the browser session is ended or the Customer logs out of their Account.
  17. Any complaints related to the use of the Store's Services can be submitted electronically to the following e-mail address: bok@mazurskamanufaktura.pl
  18. The Service Provider shall consider complaints regarding the provision of electronic services within a period not exceeding 14 calendar days.
  19. In order for the complaint to be considered, the Customer should indicate at least the reason for filing the complaint and their contact details.
  20. The response to the complaint will be provided in the form specified by the Customer (in writing or by email).

§4 Placing an order and concluding a sales contract

  1. The Store sells Goods via the Internet.
  2. The goods sold are alcoholic beverages in the form of spirits, beer, non-alcoholic beverages, and distillates.
  3. Information about Goods found on the Store's website, such as price, description, technical parameters, and other details, does not constitute an offer referred to in Article 71 of the Civil Code.
  4. Orders can be placed electronically via the Store's website 24 hours a day, 7 days a week.
  1. In order to place an order, the Customer should select the Goods to be ordered by adding them to the Shopping Cart. When placing an order, the Customer may modify both the data entered and the selected Goods until the "order and pay" button is pressed. In addition, the Customer is required to select:
    a) the method of payment,
    b) the method and address of delivery of the Goods
    c) and, if necessary, to send by e-mail the data necessary to issue an invoice.
  2. The condition for placing an order is the Customer's consent to the content of the Terms and Conditions, as well as providing Personal Data marked as mandatory. Personal Data is provided through the Customer Account service or by entering the data in the Order.
  3. Placing an order by the Customer results in submitting an offer (or offers) to the Seller to conclude a Sales Agreement concerning the Goods covered by the Order. The Seller confirms receipt of the offer (or offers) by sending an automatic message entitled "New Order" to the e-mail address provided by the Customer.
  4. After receiving the offer referred to in section 6, the Seller verifies the Order received. The sales contract is concluded upon receipt by the Customer of an email stating "The order has been forwarded for processing."
  5. Placed Orders are visible in the "order history" tab available to Customers who have an Account.
  6. The customer has the option to verify, change, or cancel an Order until it is fulfilled by contacting us via email at: bok@mazurskamanufaktura.pl.
  7. The sales agreement is concluded in Polish, in accordance with the Terms and Conditions.
  8. The order is processed by the Store within 5 business days. This means that within this period, the ordered Goods are handed over to the entity responsible for delivery.
  9. Orders are processed only on business days, i.e., Monday through Friday, excluding public holidays.
  10. If the Customer gives additional consent, they will have the option of receiving SMS messages with information about the status of their Order.
  11. The order will be processed after the Online Store receives confirmation of successful payment from the payment processor.

§5 Price and method of payment

  1. The prices of Goods are indicated in the shopping cart. Prices include all components, including VAT at the current rate (subject to paragraph 3 below). Prices are expressed in Polish zlotys (PLN/zł). The prices of Goods are not reduced by VAT for foreign orders.
  2. The price indicated for each Product is binding from the moment the Order is confirmed.
  3. Information about the delivery cost is published during the Order placement process. The delivery cost is added to the price of the ordered Goods. Detailed rules for determining the final delivery cost of the Goods, which the Customer is obliged to bear, are specified in § 6.
  4. The total value of the Order is indicated after the Customer selects the Goods and the delivery method.
  5. The Store reserves the right to change the prices of Goods, conduct and cancel promotions and sales. However, Orders placed before the change in price, promotion or sale conditions will be processed at the prices binding in accordance with section 3 above.
  6. A non-fiscal receipt is included with each shipment. At the customer's request, an invoice is included instead of a receipt.
  7. The customer has the option to pay the price according to their choice:
    a) upon delivery – cash on delivery,
    b) via the Przelewy24 system through PayPro SA (PayPro) – an entity providing services to users, with its registered office in Poznań, at ul. Pastelowa 8 (60-198), entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań Nowe Miasto i Wilda, VIII Commercial Division of the National Court Register under KRS number 0000347935, NIP number 7792369887, with share capital of PLN 5,476,300.00, paid in full, and in the register of national payment institutions kept by the Polish Financial Supervision Authority under number UKNF IP24/2014, by means of:
  • electronic (online) bank transfer,
  • PayPal,
  • payment card -> Visa and MasterCard,
  • BLIK code (a full list of payment channels in the Przelewy24 system is available on the payment operator's website);

c) using a gift card.

8. If the delivery address for the Goods is outside the territory of the Republic of Poland, the Customer cannot make payment in the manner specified in section 7(a) above.
9. The Customer is entitled to a discount allocated by the Seller in accordance with the individual parameters of the Customer's Account. The discount applies to all items, except for items marked with the information "Product excluded from the discount." Discounts and promotions cannot be combined.

§6 Delivery

  1. The delivery of ordered Goods takes place within the territory of the Republic of Poland, except as specified in section 6 below. Goods are delivered only on business days (i.e., Monday through Friday, excluding public holidays specified in

separate regulations). Delivery time is between 3 and 10 business days from the date of order fulfillment by the Store.

  3. The ordered Goods are delivered to the Customer's address specified in the Order.
  4. The Seller shall bear the delivery costs for Orders with a total value equal to or exceeding PLN 350 net, except for the situations specified in section 7 below. In other cases, the delivery costs shall be borne by the Customer.
  5. The delivery cost depends on the payment method and order value, as shown in the delivery table.
  6. The customer may also specify a delivery address outside the territory of the Republic of Poland. However, delivery outside the territory of the Republic of Poland is only possible via courier. In the case of shipments outside the territory of the Republic of Poland, the delivery cost is borne by the Customer regardless of the value of the order. At the same time, if a delivery address outside the territory of the Republic of Poland is selected, the Customer cannot pay on delivery.
  7. The cost and estimated delivery time outside the territory of the Republic of Poland depends on the destination country.
  8. In accordance with the Terms and Conditions, the condition for purchasing goods using the Store's communication functionality is to authorize the Courier to collect the products purchased by the Customer. The Store reserves that, in accordance with the agreement concluded between the Store and Fedex Polska, the Courier is entitled (power of attorney service to confirm adulthood) to hand over the Goods to a sober and adult person. In case of doubt as to the age of the person receiving the Goods from the Courier, such person may confirm their age with a document bearing a photograph and date of birth. If the Courier is unable to deliver the Goods in accordance with the provisions of this section of the Terms and Conditions, the Seller shall submit a statement of withdrawal from the agreement within 3 days and refund the purchase price to the Customer.

§7 Right to withdraw from the contract

  1. Pursuant to the Consumer Rights Act of May 30, 2014 (Journal of Laws of 2024, item 1796), a Customer who is a Consumer who has concluded a distance contract through the Store may withdraw from it within 14 days without giving any reason.
  2. The consumer may withdraw from the contract by submitting a statement of withdrawal from the contract. The statement may be submitted by email, and the email should include the order number, a statement of withdrawal from the Sales Contract, and a list of the products that the Customer is returning. This paragraph applies to withdrawals from the contract submitted in a form other than electronic.
  3. Partial products that are part of a purchased set are not subject to return. If the Consumer wishes to withdraw from the Sales Agreement for the set, they shall send the Seller a withdrawal from the purchase agreement for the entire set.
  4. The szybkiezwroty.pl service is not active for Store customers.
  5. The Seller shall refund the payment using the same payment methods as those used by the Buyer in the original transaction, unless the Buyer agrees to a different solution. In any case, the Buyer shall not incur any fees in connection with the refund.

§8 Personal data

  1. The Service Provider – Data Controller, pursuant to the GDPR and the UŚUDE, has the right to process the Customer's Personal Data for the purpose of using the Services (Account, Order, Newsletter, Viewing content, Shopping Cart), in accordance with the Terms and Conditions for the settlement of the ordered Goods (accounting), consideration of complaints, pursuit of claims for payment for the ordered Goods, as well as for archiving purposes and for the legitimate interests of the Administrator or a third party (described in more detail in the Privacy Policy).
  2. The data protection officer can be contacted at bok@mazurskamanufaktura.pl.
  3. Detailed information regarding the processing of Personal Data (including the information referred to in Article 13(1) of the GDPR and the rights of Customers in relation to the processing of their Personal Data) can be found in the Privacy Policy.
  4. The Service Provider processes operational data (identifiers of the Customer in the online store, IP address, information on the use of the Services) for the purposes of improving the Store and for statistical purposes.
  5. The Service Provider ensures the security of the Customer's Personal Data being processed. The Service Provider has implemented and applies physical, organizational, and technological security measures necessary to ensure an adequate level of security of the Personal Data being processed in connection with the provision of Services within the Store. The Service Provider has implemented technical measures to prevent unauthorized persons from obtaining and modifying Personal Data sent electronically (authentication measures, https protocol).
  6. The Service Provider protects Personal Data from access by third parties and disclosure, with the proviso that in certain situations the obligation to disclose Personal Data may arise from legal provisions.
  7. Providing personal data is voluntary, but sometimes necessary in order to provide Services on the terms specified in the Terms and Conditions.
  8. The Service Provider allows the Customer to use the Services within the Website anonymously or using a pseudonym in cases where it is technically possible and customary.

§9 Out-of-court methods of handling complaints and pursuing claims, and rules for accessing these procedures

  1. In the event of a dispute with the Seller, the Consumer is also entitled to use out-of-court methods of handling complaints and pursuing claims.
  2. Pursuant to Article 36 of the Act of December 15, 2000, on Trade Inspection (Journal of Laws of 2025, item 229) the competent Provincial Trade Inspection Inspector shall take measures aimed at out-of-court settlement of a civil law dispute between a consumer and an entrepreneur by:
    a) facilitating the reconciliation of the parties' positions in order to resolve the dispute by the parties themselves,
    b) presenting the parties with a proposal for resolving the dispute.
  3. Pursuant to Article 37 of the Act referred to in paragraph 2 above, permanent consumer arbitration courts at provincial inspectorates examine disputes concerning property rights arising from contracts concluded between consumers and entrepreneurs. The rules of organization and operation of permanent consumer arbitration courts are set out in the Regulation of the Minister of Justice on the rules of organization and operation of permanent consumer arbitration courts of September 25, 2001 (Journal of Laws of 2017, item 1014).
  4. The proceedings for out-of-court settlement of consumer disputes referred to in paragraph 2 above shall be initiated at the request of the consumer or entrepreneur, submitted to the provincial inspector competent for the place of business of the entrepreneur.   5. Proceedings before a permanent consumer arbitration court referred to in section 3 above shall be initiated upon a request submitted to the provincial trade inspection authority with territorial jurisdiction. Application forms are available at the secretariat of each permanent consumer arbitration court and on the websites of provincial trade inspection inspectorates. The contact details of permanent consumer arbitration courts can be found at: http://www.uokik.gov.pl/wazne_adresy.php.
  6. Consumers are also entitled to use the online dispute resolution system. At https://ec.europa.eu/consumers/odr/main/index.cfm? event=main.home2.show&lng=PL, there is a platform enabling out-of-court dispute resolution between consumers and entrepreneurs by electronic means, in the event of a dispute arising from an online sales contract or service contract (ODR Platform).

§10 Service Newsletter

  1. The Service Provider provides a Newsletter Service (which is a service provided electronically) consisting of sending commercial information about products, promotions, discounts, competitions, and events related to the Service Provider's activities to the email address and, optionally, the telephone number provided by the Customer.
  2. In order to conclude a contract for the provision of the Newsletter Service, the Customer must perform the following steps:
    a) provide at least their email address in the appropriate field and tick the checkbox to consent to receiving commercial information,
    b) confirm subscription to the Newsletter by clicking the "confirm subscription" button in the email sent by the Service Provider to the email address provided.
  3. The Newsletter service is provided at the Customer's request. Use of the Newsletter service begins upon confirmation of registration, as referred to in section 2(b) above.
  4. The Newsletter service is provided free of charge and for an indefinite period.
  5. The Customer may subscribe to the Newsletter Service via a dedicated subpage ("Newsletter") available within the Store, together with registering for a Customer Account or filling out the Order Form.
  6. Providing your email address in the Newsletter Registration Form is necessary for the provision of the Newsletter service. Providing other Personal Data in the form is at the Customer's discretion. This data is used to tailor the content of the Newsletter to the Customer's needs (e.g., by receiving information about promotions in brick-and-mortar stores located closest to the city specified by the Customer).
  7. If the Customer agrees to receive commercial information as part of the registration form for services provided electronically, Customer Account or Order, the Customer will also receive (regardless of the information specified in section 6 above) commercial information (including additional discounts and promotions) tailored to their interests and preferences (but not significantly influencing their decisions).
  8. The Customer may also provide their mobile phone number for the purpose of the Newsletter Service. In such a case, the Newsletter Service will be provided in the form of e-mails and text messages.
  9. The Customer may use the Newsletter Services anonymously. However, this is only possible if the email address provided does not allow the Customer to be identified and the Service Provider does not have any other Personal Data about the Customer.
  10. The Customer may unsubscribe from the Newsletter at any time (without giving any reason and without incurring any costs). To do so, the Customer may use the deactivation link provided in each e-mail message received as part of the service, send an e-mail message with information about the cancellation to the Service Provider's address indicated in the Terms and Conditions, or use the Newsletter functionality within the Customer Account. Upon unsubscribing, the contract for the provision of the Newsletter Service is terminated.

§11 Final provisions 

  1. The relevant provisions of the Sales Agreement shall be recorded, secured, and made available to the Customer by sending a message confirming the Order placed to the specified e-mail address and delivering a non-fiscal receipt or invoice in the shipment.
  2. The customer can access the Terms and Conditions at any time via the link provided on the website www.darkshop.com.pl/.
  3. The customer also has the right to download and print the Terms and Conditions themselves.
  4. In matters not covered by these Terms and Conditions, the generally applicable provisions of Polish law shall apply, in particular the Civil Code of April 23, 1964 (i.e. Journal of Laws of 2025, item 1071) and the Consumer Rights Act of May 30, 2014 (Journal of Laws of 2024, item 1796).
  5. The Service Provider reserves the right to amend the Terms and Conditions. Any amendments to the Terms and Conditions shall become effective on the date specified by the Service Provider, which shall be no less than 14 days from the date of their publication on the Store's website. The amendments shall not infringe upon the acquired rights of Customers.

§12 Omnibus Directive

  1. The website https://www.darkshop.com.pl/ displays all prices of Goods from the last 30 days.
  2. Due to the architecture of the Store, the lowest price from the last 30 days for the largest number of sizes is displayed below the price of the Product on the product card.
  3. Due to the architecture of the Store, the lowest price from the last 30 days for a particular size is included in an accordion called: "30-DAY PRICE." It expands automatically when you click on the "Lowest price in the last 30 days" option or when you click on the "+" sign next to the "30-DAY PRICE" accordion.
  4. Each price reduction advertisement shall indicate the previous price, whereby the previous price means the lowest price applied during a period which may not be shorter than 30 days prior to the application of the price reduction.

The regulations come into force on October 1, 2025.
